Welcome to Cheeriosity.ca (“the Website”). These terms and conditions (“Terms”) govern your use of the Website and the purchase and use of any products from Cheeriosity Inc. (referred to as “the Company,” “Cheeriosity,” or stylized as “CHEERiosity”). By using the Website or purchasing and using any products from Cheeriosity, including The Game of CHEERiosity, you agree to be bound by these Terms. Please read them carefully before using the Website or the products.

1. Acceptance of Terms

By accessing the Website or using any products purchased from the Website, you agree to comply with and be bound by all of the Terms listed on this page. If you do not agree to these Terms, you may not use the Website, make a purchase, or use the products purchased from the Website. You are responsible for reading and understanding all written Terms and/or policy information on Cheeriosity.ca prior to making a purchase from the Website.

• Products

We strive to provide accurate descriptions and images of our products. However, we do not guarantee that product descriptions or other product related content on the Website are accurate, complete, reliable, current, or error-free. 

• Orders

All orders are subject to availability and acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspicion of fraudulent activity.

5. Pricing and Payment

• Pricing

Prices for products are listed in the currency specified on the Website and are subject to change without notice. All prices are exclusive of applicable taxes and shipping fees, which will be added to your total order price.

• Payment

Payment for orders must be made in full at the time of purchase. We accept payment via credit card and E-Transfer. All payments must be completed before any product will be shipped. If paying by E-Transfer, please ensure payment is made promptly when placing the order. If payment is not made promptly, the Company reserves the right to cancel your order. By providing payment information, you represent and warrant that you have the legal right to use the provided payment method.

6. Shipping and Delivery

• Shipping

Once an order has been handed over to our shipping partner (Canada Post, UPS, or Purolator), it is considered complete, and the risk of loss passes to you upon delivery of the items to the carrier. If you experience a shipping issue, such as late delivery, a damaged parcel, or a missing parcel, you are responsible for filing a claim directly with the carrier. We will assist where possible and encourage you to contact us at support@cheeriosity.ca if you experience a shipping related issue. We also encourage you to purchase shipping insurance if you are concerned about potential shipping issues. Tracking numbers for each parcel will be provided once your order has shipped.

• Shipping Restrictions for Quebec

Due to the stringent multilingual requirements mandated by the Quebec government, we regret to inform you that we are currently unable to ship our products to Quebec. This decision is made to ensure compliance with the Charter of the French Language (Bill 101) and to avoid any inconvenience to our customers regarding language accessibility.

We understand the importance of providing a product that meets the linguistic needs of all our customers, and we are actively working on developing a multilingual version of our product. We anticipate that this version will be available in the near future, at which point we look forward to serving our valued customers in Quebec. We apologize for any inconvenience this may cause and sincerely appreciate your understanding as we work towards making our products accessible to a broader audience. Please stay tuned for updates regarding the availability of our multilingual product.

• Delivery

The risk of loss and title for products purchased from the Website pass to you upon delivery of the items to the carrier. The Company is not responsible for any damages or losses incurred during shipping. Please ensure that any claims related to shipping are filed with the carrier in a timely manner to avoid delays in resolution.

7. Returns and Refunds

• Returns

We accept returns of unopened and undamaged products within 15 days of delivery. To initiate a return, please contact our customer service team for instructions and obtain a Return Merchandise Authorization (RMA) number. Please note that we are unable to process or accept returns without an RMA number. If you have an item that was damaged during shipping, please see the section above on Shipping and Delivery.

• Refunds

Refunds will be issued to the original payment method within a reasonable period after we receive and process the returned items. Shipping fees are non-refundable, and you are responsible for return shipping costs unless the return is due to our error.

8. Warranty Policy 

All products purchased from Cheeriosity Inc., including The Game of CHEERiosity, are subject to the terms of our Warranty Policy. We require you to read and understand our Warranty Policy prior to making a purchase. By placing an order, you acknowledge that you have reviewed and agree to the terms of the Warranty Policy, which can be found here. The Warranty Policy governs any claims regarding defects in materials or workmanship.

9. Intellectual Property

All content on the Website and any intellectual property contained within The Game of CHEERiosity and other physical game products, including text, graphics, logos, images, videos, audio clips, digital downloads, software, game design, rules, and any other content, is the property of Cheeriosity Inc. or its content suppliers and is protected by copyright and other intellectual property laws. Any items purchased from the Website are also protected in the same manner. You must receive permission in writing prior to reproducing any of the text, graphics, logos, images, videos, audio clips, digital downloads, software, game design, rules, or any other content from the Website or the products.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Cheeriosity.ca and Cheeriosity Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Website or any products purchased from it.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right to update, change, or replace any part of these Terms at any time without prior notice. It is your responsibility to check this page periodically for changes. Any changes will become effective immediately upon being posted on our website. The information on our website will take precedence over any previously written or published warranty information.
